In-Kind Repairs: Replacement Facilities

The total cost of a project may not exceed the cost of repair or reconstruction of a comparable facility that meets the current geometric and construction standards required for the types and volume of traffic that the facility will carry over its design life (see 23 USC Section 125 (d) (2)).

Replacement of a highway facility at its existing location is appropriate when it is not technically and economically feasible to repair or restore a seriously damaged element to its pre-disaster condition and is limited in ER reimbursement to the cost of a new facility to current design standards of comparable capacity and character to the destroyed facility (see 23 CFR 668.109 (d)).
